You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

The Information that we Collect, How we Collect it, and How we Use it


Personal data are processed by Max Klayden sp. z o.o., Grzybowska 87, 00-844, Warsaw, Poland, European Union, Tax Identification Number: 5272872751, National Court Register Number: 0000759464, Statistical Number: 381885115, in order to use when necessary during your activity on our store. We collect information in two ways. First, we collect it automatically when you visit our websites or use our products and services. Second, we use it when you log in with your Facebook credentials through a Facebook or Instagram referral. 

When you purchase something from our store, as part of the buying and selling process, we collect personal information you provide us such as your name, address, and email address. Additionally, when you complete a purchase with Max Klayden sp. z. o.o., we share your submitted shipping address for shipping purposes only. 


When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system. With your permission, we may send you emails about our store, new products, and other updates. We never sell or present personal data to a third party. We may disclose your personal information only if we are required by law to do so or if you violate our Terms of Service.

Data Storage

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data are stored through Shopify’s data storage, databases, and the general Shopify application. They store your data on a secure server behind a firewall.

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data are stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

Max Klayden sp. z o.o. does not store nor see any credit card information.

Security of Data

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands such as Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

The Seller undertakes the highest effort to assure that the terms and conditions of sale will form customers' rights and obligations in accordance with good practices and taking into consideration customers' interests. Clients should note that our store is hosted on Shopify Inc. Shopify Inc. provides us with the online e-commerce platform that allows us to sell our products and services to you.

We make the Terms of Use available in .pdf format, which can be downloaded and
registered on your final device.

Acceptance

The customer should familiarize himself or herself with Terms of use. During registration on the website www.paulrichwatches.com or when placing an order, the customer will be asked to accept the resolutions of Terms of Use by marking “X” in a checkbox.

Order Fulfillment 

Online store sells products on the Internet, using the website www.paulrichwatches.com, on which orders may be placed. The subject of order will be further called “the Product”. The catalogue of the products is located on the website https://maxklayden.com/collections/all.

The client places the order by choosing products and putting them in a shopping cart. The client receives confirmation of placing the order together with the order number by e-mail (to the e-mail address indicated when placing the order). An invoice may be issued on client’s demand. The invoice is sent to the client by e-mail (to the e-mail address indicated when placing the order). In that case the client agrees to issue an invoice and to have it sent by e-mail to the e-mail address he or she provided.

Orders most often take between 3 and 5 business days to arrive at their destination.

Terms of Payment

We use PayPal and Checkout.com to process payments, so our staff is unable to see your payment details. PayPal is the world's largest and most secure payment provider. We accept PayPal and credit/debit cards (Visa, MasterCard, American Express). If you have a PayPal account, but you are having problems with sending money or logging into PayPal, please contact PayPal customer service. We don’t accept the service for cash on delivery (COD). We process orders in USD, EURO, GBP. While the content of your card may be displayed in other currency, you will checkout using USD, EURO, or GBP at the most current exchange rate.

Sales, Custom and Value-added taxes

In an effort to remain compliant with respective consumer legislations, we strongly encourage our end customers to maintain good standing with respect to customs and value-added taxes, where applicable. Due to separate and applicable tax jurisdictions, the end customers’ purchases may be subject to specific sales, customs or value-added taxes, and the shipping time and associated cost may increase.

Cancellation of orders

All orders and product shipments can be cancelled within 12 hours. If your order has been paid and you need to make a change or cancel an order, you must contact us within 12 hours following payment. After 12 hours, once the packaging and shipping process has started, it can no longer be cancelled.

Prices

Prices of products are in USD, EURO, GBP only, and are gross prices. Prices located near products do not contain information about shipping costs, unless the delivery is indicated as “free shipping”. The total order cost is presented in clear and explicit way during review, after the choice of payment and delivery had been made. Before choosing a delivery option, the customer can check delivery costs at www.maxklayden.com/shipping. 

We do not apply default options with hidden payments.

Refunds and Returns

If you are not completely satisfied with your purchase, simply return the item to us under
the condition that you are liable for any decrease in product’s value resulting from the usage of the product in a way beyond necessary to get to know the character, features and functionality of the product within 14 days of receipt by contacting

We do not refund return shipping costs on orders less than €50. 


The period in which you may withdraw from the contract begins on the day when you or a third party indicated by you other than the shipper takes possession of the product. To withdraw from the contract you should notify us of your decision by making a clear statement declaring withdrawal from the contract. Withdrawal from the contract may concern all of the ordered products or only a part of them. Posting the statement declaring withdrawal from the contract to us within 14 days of receipt is equal to withdrawing from the contract in the required period. Statements declaring withdrawal from the contract sent by post should include the postscript “withdrawal from the contract”. If statements about withdrawal from the contract are sent by e-mail, we will promptly send you an e-mail affirming delivery of the statement about withdrawal from the contract. If you adhere to the regulations above the contract is considered void.

If you want to return an item, please re-pack the item in an unchanged condition. The customer is liable to damages that decrease the product’s value resulting from the usage of the product in a way beyond necessary to get to know the character, features, or functionality of the product. You can expect to receive your refund within 72 hours of your package return. However, in many cases you will receive a refund more quickly. We will cover the cost of standard, cheapest shipping for return packages. 

We will return the payment to the card used during purchase. You are
obliged to return the order promptly by posting it to us not later than 14 days after the day in which you withdrew from the contract. It is sufficient to post the items back to preserve the term. You are liable for damages that decrease product’s value resulting from the usage of the product in a way beyond necessary to get to know the character, features and functionality of the product.

Items purchased for a discount price

Items on sale can be returned. That includes ANY discount.

Complaints concerning faulty products

We are bound to deliver products free from any defects. In a case a product has a deficiency, appropriate regulations to examine complaints are the regulations of the polish Civil Code dated 23 rd of April 1964 (Dz.U. 1964 nr 16 poz. 93 with further changes), among others articles 556-576.

The customer has the right to make a complaint based on the regulations of the guarantee, if the product is faulty. There are two types of faults: physical fault and legal fault. Physical fault is when the product is not compatible with the agreement. Physical fault is in particular when (i) the product does not possess the characteristics that the products of this kind should possess, (ii) the product does not possess the characteristics about which the client was assured by the seller or advertisement, (iii) the product cannot be used to achieve the goal about which the seller was informed by the buyer, (iv) the product was sent to the client incomplete. 

In a situation that a fault takes place, the customer can according to our guarantee make a complaint and demand one of the below actions:

a) exchange the faulty product for a new one;

b) repair the faulty product;

c) partial refund for the faulty product;

d) waive the purchase agreement when the fault is important.

The choice of the action belongs to the customer. Under particular conditions we are able to propose other solutions, but only considering the circumstances listed below:

a) facility and speed of exchange and repair of the product;

b) the character of the fault – important or not;

c) if the client has made any earlier complaints.

If the customer demands the exchange or repair of the item, we can refuse to fulfill this demand under the condition that the option indicated by the client:

a) would be impossible for us to fulfill;

b) would demand excessive costs in comparison to other solutions.

We can propose other solutions. Regardless of the previous solution, in this situation the customer can change his preferred choice and demand to bring the product back to the state specified in the agreement. We are obliged to replace the product or remove the defect in a reasonable time, no longer than 14 days since product receipt. If we do not meet this limit you can set a time demand, which we have to meet, but no shorter than additional 14 days. If we do not meet the deadline you are entitled to withdraw from the agreement or demand a partial refund for the product.

We bear the responsibility for a faulty product, if the fault takes place in a period of two years since the day of delivery. A complaint can be delivered in any form. For evidence purposes it is recommended to do this in writing. You should describe the fault and specify your demands as outlined in the guarantee. Proof of complaint may be sent directly to the us by a registered letter with reversible affirmation of delivery or sent by e-mail to support@maxklayden.com

If the demand placed by you in the complaint applies to:

a) repair of the product,

b) exchange of the product for a new one,

c) partial refund,

we are obliged to process your complaint within 14 calendar days from the date of the complaint. If we exceed this term your complaint is considered justified, no matter the factual state of the complaint. 

The products under complaint should be send back together with the information concerning the cause of the complaint to the address: Max Klayden sp. z o.o., Grzybowska 87, 7th floor, 00-844, Vimar Office, Warsaw, Poland, European Union with additional postscript: „COMPLAINT Max Klayden”. In addition to sending the complaint, the customer can demand the return of costs associated with sending us back the product.

If we refuse your complaint and you do not agree with our decisions you can turn to the Permanent Consumer Arbitral Court to perform mediation or to receive a settlement of dispute. In order to do so you should apply to regional appropriate Voivoidship Inspectorate of the Trade Inspection. All details, contact data, and the list of permanent arbitral consumer courts are located on the website of Office of Competition and Consumer Protection [https://uokik.gov.pl/spory_konsumenckie.php]. The client is also allowed to use the online platform, which is an alternative way of solving conflicts, so called ODR Platform (Online Dispute Resolution) Platform. According to the above act the client of the online store www.maxklayden.com has a right of insight to his or her personal data, can modify his or her personal data, and can also demand to remove his or her personal data.

Above data is processed by us only to accomplish the order, among others to inform the client about the status of the order or to get the client’s opinion about his satisfaction with the delivered order. The customer is obliged to respect copyright law of the content posted on the website in accordance with the Polish Act of copyright and related rights, dated February 4th, 1994 (Dz.U. 1994 nr 24 poz. 83 with further changes). Access to some of the website’s features requires registering and logging in. Using the website is voluntary. Registering on the website is free. It is prohibited to post on the website content which is unlawful, proclaims racism, aversion to creed, ethnicity or popularizes violence, is commonly recognized as morally reprehensible, socially inappropriate or breaching rules of ethic.

The answer will be sent within 14 days since the receipt of the complaint to the address indicated in the complaint.

Termination of the Agreement

Both sides have the right to terminate the agreement concerning internet services, which is regulated in this Terms of Use, preserving the term of termination of 14 days. The declaration of termination of the agreement should be sent by e-mail. The client is obliged to send such termination to the e-mail address: support@maxklayden.com. The seller is obliged to send such termination on the e-mail address of the client. The order placed before the termination of the agreement is fulfilled under the conditions regulated by this Terms of use.

Changes of the Terms of use

Customers will be informed about changes to the Terms of Use by e-mail at least 14 days before the change together with a request to accept the new regulations of Terms of Use.
